By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with The Instructor College RTO #45713 - ABN 45 630 799 709.

The Instructor College RTO #45713 reserves the right to update and change the Terms of Service without notice.


FEE AND REFUNDS 

PURPOSE 

The Instructor College Pty Ltd is committed to providing quality training and assessment services in accordance with the Standards for Registered Training Organisations (SRTOs 2015) which includes a fair and transparent policy and procedure for charging, protecting and refunding course and related fees. 

The Instructor College implements financial safeguards for fees, charges and subsidies received from all students and training service clients. The Instructor College undertakes to ensure that all fees and charges paid are recorded in the appropriate manner to guarantee financial integrity. 

SCOPE 

This policy forms part of The Instructor College’s Quality Management System and applies to all fees, charges and refunds applicable to the provision of programs and courses offered by The Instructor College and those of The Instructor College’s related entities. It applies to students paying full fees, and students entitled to concession fees and exemptions. 

POLICY STATEMENT 

The Instructor College makes every effort to ensure potential clients and students are made aware of the relative fees, charges, available concessions and exemptions and refund arrangements for all programs offered before accepting a student for enrolment. 

The Instructor College is committed to ensuring fair and reasonable financial practices. In doing so, we will: 

  1. Implement and maintain a process for fair and reasonable refund of fees paid; and  
  1. Provide refunds for fees and charges paid by individuals / clients, where training and assessment activities have not been delivered. 

PROCEDURES 

Notifying fees and charges 

Students and/or their employers will be advised of any fees, charges, available concessions and exemptions and resource costs relating to their study program prior to, or at the time of, enrolment. Payment arrangements are aligned to courses and may vary depending upon factors such as length of course, student cohort, government contract guidelines etc.  

The Instructor College advises its fees and related costs in course promotional materials including course guides and information packages, on our website, in quotes for industry training, and in pre-course invoices.  

Fees and charges are non-transferable to other students or other institutions.  

Administration and resource charges  

These may include non-refundable administration fee, enrolment fee, learning resources essential for the course, items which are consumable or transformed by students during the course, text books, photocopying, additional copies or re-issue of qualifications and academic transcripts.  

Additional charges may also apply, including follow up charges associated with late or non-payment, overdue fees, dishonoured cheque fees.  

Any equipment/property either purchased separately by the student or paid for as part of materials fees becomes the property of the student.  

Payment arrangements  

All enrolment fees, administrative charges or other charges must be paid by the specified due dates.  

Payment may be made by EFT, direct bank deposit, or credit card. 

Non-payment of fees  

All fees and charges must be paid by the due date. Failure to pay fees and charges may result in any or all of the following, until the full amount is paid:  

  • suspension from attending or participating in the course 
  • exclusion from assessment activities 
  • withholding of qualification and academic record 
  • termination of the enrolment 
  • exclusion from any future enrolments at the Instructor College. 

Debt Recovery 

  1. Fees and charges that remain unpaid after 90 days from the due date may be referred to a debt collection agency. 

Fee Assurance 

The Instructor College is required to protect fees paid in advance for nationally recognised training. To meet this regulation, The Instructor College may accept payment of no more than $1,500 from individuals prior to the commencement of their course.  

Following course commencement, The Instructor College may require payment of additional fees in advance from the student but only such that at any given time, the total amount required to be paid which is attributable to tuition or other services yet to be delivered to the student does not exceed $1,500. 

Refunds for Programs: 

All students at The Instructor College are entitled to a refund of all or part of their course fees if: 

  • The student has overpaid the course fee 
  • The Instructor College cancels the course for any reason 
  • the student has medical, hardship or another extenuating circumstance which prevents their attendance. The RTO Manager will assess applications for these circumstances on a case by case basis; or 
  • in the opinion of the RTO Manager, the course and/or its delivery has not met the reasonable expectations of the students. 

Non-refundable circumstances 

If a student chooses to withdraw from an enrolled program 10 working days prior to course commencement, a non-refundable administration fee of $450 will apply. Students will be informed of the amount in pre-enrolment information. 

No refunds of course fees will apply after the course has commenced. 

The Instructor College will not refund course fees where the student requests the refund because they: 

  • change their mind about attending the course after they have enrolled in the course 
  • change jobs 
  • change work hours 
  • move out of the area; or 
  • are made redundant or retrenched. 

Approving Refunds 

  1. All refunds must be approved by the RTO Manager. Exemptions to the refund conditions may occur where the student has extenuating, or compassionate grounds as determined by the RTO Manager or their delegate.  

Credits for course fees 

Students may apply for a credit of course fees, less the applicable non-refundable administration fee of $450, if they give ten (10) working days’ notice of cancelling their enrolment prior to the course commencing.  

The RTO Manager will assess any request where the student gives less than ten (10) working days’ notice. 

A student wishing to give less than ten (10) working days’ notice of cancelling their enrolment may be offered the opportunity to enrol into the subsequent course and, if a space is available in that course, may then enrol without further charge.  

NOTE: Any credit issued only remains valid for a period of 12 months. After this period any credits will be forfeited. 

Transfers to other courses 

Students may apply for a transfer of course fees to another course of their choice, less the applicable non-refundable administration fee of $450, if they give ten (10) working days notice of cancelling their enrolment, prior to the course commencing.  

The RTO Manager will assess any request where the student gives less than ten (10) working days’ notice. 

Only one transfer per an enrolment is permitted, unless the transfer relates to a course(s) that The Instructor College cancels for any reason. In this case, the administration fee will not apply. 

Publishing the refund policy 

Excerpts from this policy will appear in The Instructor College Course Guides, on our website and will be included in the Enrolment Terms and Conditions. 

Student’s right to appeal decisions 

If a student is not satisfied with the conditions under which a refund or partial refund is paid or denied, The Instructor College’s Complaints Handling Policy and Procedure can then be applied. This policy, and the availability of complaints and appeals processes, does not remove the student’s right to act under Australia’s consumer protection law. 

GUIDE TO FEES AND CHARGES

Provide student with credit or transfer letter. Only one transfer per enrolment is permitted. 

Any credit issued for a non-refundable circumstance must be used within 12 months or it will be forfeited.

A student requests a refund because, after the course has commenced, they have: 

  • changed their mind about attending the course. 
  • changed jobs. 
  • changed work hours. 
  • moved out of the area; or 
  • been made redundant or retrenched.
Refunds will only be permitted in extenuating circumstances of hardship. A non-refundable administration fee of $450 may apply Must be approved by RTO Manager
A student requests a refund of costs for resource and/or materials purchased by The Instructor College and consumed or transformed by students during the course Resource/ materials fees are outlined prior to enrolment and are only refundable if the student cancels the enrolment prior to commencement of training and where the student has not taken possession of the items.   
The Instructor College refuses to continue the student in the course because of student misbehaviour failure to pay due fees  No refund applies in this circumstance  
A student requests a Certificate of Completion for a non-accredited course, where the course does not already include a Certificate in the course fees.  $15 fee applies

Student must have attended at least 80% of the course to be eligible. 

Requests must be made within 6 months of course completion

A student requests a document re-issue where The Instructor College has already provided that document to the student $60 fee applies

Includes: Statement of Attainment Certificate, or Academic Transcript

A student requests credit transfer for a unit of competency issued by another training organisation  No charge applies To be eligible for credit transfer, the unit code and name must match exactly.
RPL (Recognition of Prior Learning) assessment fee 50% of the current course fee applies Please see RPL policy/procedures for further guidance 

VARIATIONS 

The Instructor College reserves the right to vary, replace or terminate this policy from time to time.

Account Terms

This page contains the most current version of the Terms of Service.

  • Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  • You are responsible for all activity that occurs from your account.
  • You agree that The Instructor College RTO #45713 can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  • You must not post or submit false information to the Service.
  • You are responsible for maintaining the security of your account and password. The Instructor College RTO #45713 cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  • The Instructor College RTO #45713 has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other The Instructor College RTO #45713 service, for any reason.
  • Violation of any of the terms or general conditions may result in the termination of your Account.
  • In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, The Instructor College RTO #45713 has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other The Instructor College RTO #45713 service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

  • Less than 48 hours notice before the booking will not incur any penalty.
A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at The Instructor College RTO #45713.

 

Modifications to Services and Prices

  • The Instructor College RTO #45713 reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  • Prices of all Services are subject to change with or without notice.
  • The Instructor College RTO #45713 shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Vouchers

  • Vouchers are non-refundable and cannot be redeemed for cash.
  • Unused vouchers cannot be transferred between clients.
  • Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.

Fees

  • Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by The Instructor College RTO #45713 for payment processing.
  • All fees and transactions are in Australian Dollars.

General Conditions

  • Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by The Instructor College RTO #45713.
  • Verbal, physical, written or other abuse (including threats of abuse or retribution) of any The Instructor College RTO #45713 customer, employee, member, staff, officer or external contractor will result in immediate account termination.
  • You must not transmit any worms or viruses or any code of a destructive nature.
  • You understand that The Instructor College RTO #45713 uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  • The Instructor College RTO #45713 does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  • You expressly understand and agree that The Instructor College RTO #45713 shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if The Instructor College RTO #45713 has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  • The failure of The Instructor College RTO #45713 to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  • You expressly understand and agree that The Instructor College RTO #45713 shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
